Kodak story on TV tomorrow

The ongoing Kodak DX3700 ‘special offer’ news momentum is gathering pace.

We have a response from a Trading Standards officer in Ealing that should boost the confidence of those who might be willing to challenge Kodak. Plus we hear the story has been discussed on Radio 5 Live and one customer, Richard Druane, has even set up a Web site dedicated to the topic. He’s been invited onto the Working Lunch TV programme on BBC2 tomorrow. We’ve just checked his site, hosted by Yahoo (http://www.richardruane.co.uk/) but it’s down as we write this because its traffic allowance has been exceeded. That’s one popular site. Indeed, our own site traffic has tripled in the last three days.

The good news?

Here is what one DPN reader forwarded to us late this afternoon, from Ealing Trading Standards:


As far as I understand the matter, Kodak confirm that the order is being processed and also inform customers of their right to cancel - consequently, I would argue that they have entered into a legally binding contract

This means that you should be able to insist that the they honour their part of the contract by delivering the goods to you. If they fail to do this, you may ultimately be able to sue them for loss of bargain which would be the difference between the advertised price and the actual price you end up paying for the goods.
 

That certainly looks encouraging. We’ll bring you more when we get it.
